Ordering: Soon after you place your order we will check the availability of item and delivery details. Then we will contact you by email or telephone. If we cannot complete the order we will contact you via email or telephone within 24 hours. If the product is available and the details of the Order are correct no further contact will be made. The original email will be deemed as acceptance if we do not contact you within 24 hours. This will specify delivery details and confirm the price of the products purchased. If the Product is not available we will also let you know by email or telephone.

We must receive payment of the whole of the price for the products that you order before your order can be delivered. Once payment has been received by us we will confirm that your order has been accepted by contacting you at the email address or telephone number you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.

All new Orders are deemed separate and each is treated individually. All items are subject to availability.

 

Price: The price for each product is shown on our web site.

You will be required to pay extra for delivery and it might not be possible for us to deliver to some locations, in that case we will inform you of our delivery area restictions. Our delivery charges will be confirmed once you have selected your order and delivery date and address.

Occasionally, your delivery address may be classified as 'remote' by our courier which means that different delivery times and rates may be applicable. Should this be the case, we will contact you before your order is processed advising of the delivery time and rate. You will then be given the option of proceeding with the new costs or canceling your order.

We always try to make sure that the prices on our web site are accurate but occasionally errors may occur. If we discover an error in the pricing of the products in your “Order Form” we will inform you as soon as possible using the contact details you provide. We will then give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to reach you we will treat the order as cancelled. If an order is cancelled due to our pricing error, any payment made for the products will be refunded in full.

 

Re-Sale: You are not permitted to re sell any of our products without our written permission.

 

Products and Allergies: Blooming Delicious’ chocolate bouquets may contain traces of nut. Most of our bouquets contain sharp items therefore should be handled with care. The product and packaging are not suitable for children. Children must be supervised with an adult at all times.

 

Cancellation by customer: Orders may be amended or cancelled up to 3 working days before the intended delivery date; in case of cancellation, any payment made for the Products will be refunded however a minimum of 10% of payment made for administration fee will be taken.

Orders amended or cancelled by customer 2 working days prior to delivery date will incur 50% refund of the payment made for the products.

We regret to offer any refund of the amount paid for products, if orders amended or cancelled 1 working day prior to delivery date. No order may be cancelled in the last 24 hours prior to delivery.

Occasionally there might be some charges for amending an order.

We regret that you may not cancel an order for products once your order has been dispatched.

 

Cancellation by us: We reserve the right to cancel the contract between us if:

·          We have insufficient stock to deliver the products you have ordered. If this is the case, we will contact you to advise of an alternative date or to offer you suitable alternative product;

·          We can not deliver to your area

·          One or more of the products you ordered was listed at an incorrect price due to a typing error

·          Any other circumstances such as road closure, flood, fire, strike and etc. 

If we do cancel your contract we will notify you by e-mail or phone and will return any amount which has been paid to us. We will not be obliged to offer any additional compensation for disappointment suffered.

 

Delivery Area: It is your responsibility to check our delivery area for all our products.If an order was placed to be delivered out site our delivery zone without our knowledge and prior arrangements, you will be responsible for it. In such circumstances, we will treat the order as "cancellation by customer" and any payment for the product will be refunded, however a 10% of payment for adminstration fee will be taken.

  

Delivery of products to you: We will deliver the products ordered by you to the address you give us for delivery at the time you make your order. It is, however, your responsibility to provide us with accurate delivery address details. We will not check or verify addresses and messages supplied by you. Delivery times are merely an estimate and are not guaranteed. We will make every effort to deliver within the estimated delivery time but we will not be liable for any loss caused to you by late delivery.

If the address supplied by you is a non-residential address (e.g. business/hospital/hotel) we will deliver to the reception/security/receiving bay in area of the building, accepting a signature from an authorised representative of the business / hospital/hotel. You should specify the relevant department / ward name / room number of the recipient in the address field when placing your order. Any other details that will help us to deliver your order to the correct person at the correct time should be provided during the process of completing the order.

You will become the owner of the products you have ordered when they have been delivered to you or your given delivery address. Once products have been delivered to you they will be held at your own risk and we will not be liable for their loss or damage. Any re-direction costs incurred will be charged.

In circumstances where we are unable to make a delivery, we will inform you either by telephone or email to arrange another delivery time and date. In such circumstances, if another time and date is not suitable, we will offer a refund if we are unable to make a delivery. Blooming Delicious will not be liable for any compensations in such circumstances.

Incorrect or insufficient delivery details can result in late or non-delivery of orders. In such circumstances, We will try to remedy the situation as best as possible. However, there will be NO REFUNDS made in such circumstances.

If the recipient is not present on delivery, we will attempt to leave the order with a neighbor or according to alternative instructions which have been provided to us upon order.
If a neighbor is not available the order will be left, without a signature, eg on the porch, garden etc. In all cases, it is the SOLE responsibility of the customer to make sure that the person is available to receive the order. There will be no refunds made in such circumstances. Deliveries cannot be made to P.O. Box addresses.

Please check the delivered Products as soon as possible on receipt as we will not cover any subsequent loss or destruction.

Blooming Delicious will provide its services with reasonable skill and care but does not give any guarantees, warranties in respect of any other person such as postal services.

 

Liability: If the products we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, or if you do not receive the products ordered, we shall have no liability to you other than as set out below.

  •   If you notify a problem to us under this clause, our only obligation will be:
  •    to put right any shortage or non-delivery;
  •    to supply and deliver substitute products if your original choice cannot be delivered for any reason;
  •    to refund to you the amount paid by you for the products in question in whatever way we choose.
  •    we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the products after deduction an adminstration fee, under this section.

You may not use this website for any of the following purposes:

Disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material or otherwise breaching any laws;

Transmitting material that encourages conduct that constitutes a criminal offence, or otherwise breaches any applicable laws, regulations or codes of practice;

Interfering with any other person's use or enjoyment of the website; or

Making, transmitting or storing electronic copies of materials protected by copyright or other intellectual property right without the proper permission.

You will be responsible for our losses and costs resulting from your breach of this section.

 

Returns: We believe that you will be delighted with your product but there may be occasions where you feel it necessary to return an item. We aim to keep the process as simple as possible. Products may not be returned unless there has been an error on our part or because the product is inedible.

To return a product please call 0771 7474 641 on the day of delivery. Return requests made after delivery date will not be considered. Customers will be liable for any cost involved with returning a product. There might be some administration charges for any returned products.

This does not affect your statutory rights.

 

Events beyond our control: We shall have no liability to you for any failure to deliver products you have ordered or any delay in doing so or for any damage or defect to products delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation to, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

 

Data protection: Blooming Delicious makes a commitment to protecting your privacy and promises only to use information collected about you in accordance with the Data Protection Act 1998.

When you place an Order, we may ask you for certain information and you may submit personal data,for example your name, phone number, postal address, email address. We may also record which products you are interested in and which products you purchase. This information will be kept securely and may be used to:
1) process your Order,
2) provide you with an up to date, efficient, and reliable service,
3) provide a more personal shopping experience.
By making an Order and submitting your data you agree to this use.

We may also use information to improve the service to our customers.
